TERMS & CONDITIONS OF SERVICE

1. OUR SERVICE

Shaman Dreams Wellness provides a personal shopping, procurement, coordination, and delivery service designed to assist customers in obtaining legally available cannabis products from authorized cannabis retailers and other lawful sources.

Shaman Dreams Wellness acts at the direction and authorization of the customer.

Our service is designed to save customers the time, travel, and inconvenience associated with locating, obtaining, and transporting products themselves.

Our Services may include locating requested products, communicating with retailers, shopping or procuring products at the customer's direction, transporting products, and delivering the customer's requested products.

2. CUSTOMER AUTHORIZATION AND AGENCY

By submitting an order through Shaman Dreams Wellness, you expressly authorize Shaman Dreams Wellness and its authorized representatives, associates, contractors, drivers, and agents to act on your behalf for the limited purpose of providing the Services requested by you.

This authorization may include:

• Searching for requested products;
• Locating available inventory;
• Communicating with retailers;
• Shopping or procuring products at your direction;
• Selecting products according to your instructions;
• Making reasonable substitutions when authorized;
• Transporting products;
• Delivering products to the designated delivery location; and
• Performing other reasonable actions necessary to complete your requested service.

You acknowledge that Shaman Dreams Wellness is acting as your authorized service provider and personal shopper and is not independently selecting products for its own consumption or use.

3. PRODUCTS ARE NOT SOLD BY SHAMAN DREAMS WELLNESS

The customer acknowledges and agrees that Shaman Dreams Wellness provides a service of shopping, procurement, coordination, transportation, and delivery at the customer's request.

The products requested by the customer are not being offered by Shaman Dreams Wellness as products for sale to the customer.

Instead, the customer authorizes Shaman Dreams Wellness to obtain requested products on the customer's behalf from an appropriate source and to provide the associated shopping, procurement, transportation, and delivery services.

Funds received by Shaman Dreams Wellness are intended to compensate and offset the costs associated with providing these Services, including but not limited to:

• Driver compensation;
• Fuel;
• Vehicle expenses;
• Travel;
• Insurance;
• Maintenance;
• Administrative expenses;
• Technology and platform expenses;
• Communications;
• Payment processing;
• Procurement time;
• Operating expenses; and
• Other costs associated with providing the Services.

Nothing in these Terms creates or represents a conventional retail sale of cannabis by Shaman Dreams Wellness.

4. SERVICE FEES AND THE STANDARD $2-PER-MILE RATE

Shaman Dreams Wellness generally operates its delivery service using a standard rate of approximately $2.00 per mile based upon the applicable delivery distance.

The $2-per-mile figure represents our standard service and delivery rate and is not an absolute requirement applicable to every individual order.

The final service fee for a particular order may be higher or lower than the standard $2-per-mile rate when otherwise agreed upon between Shaman Dreams Wellness and the customer.

The agreed-upon service fee for an individual order controls that particular transaction.

Shaman Dreams Wellness may consider factors including, but not limited to:

• Delivery distance;
• Travel time;
• Time of day;
• Order size;
• Product availability;
• Route efficiency;
• Traffic;
• Fuel costs;
• Special delivery circumstances;
• Customer location;
• Driver availability; and
• Other operational considerations.

5. PRODUCT PRICING AND VARIABLE PRODUCT MARKUPS

Because Shaman Dreams Wellness incurs substantial costs in providing its Services, the prices presented through our platform may differ from prices displayed directly by individual retailers or other sources.

Product pricing may include a variable markup, which may differ from product to product.

Such differences may reflect the costs associated with providing our personal shopping, procurement, coordination, administrative, transportation, and delivery Services.

The amount of any applicable markup may vary depending upon the product, source, availability, operating costs, demand, distance, and other circumstances.

Product pricing and service charges may change without notice before an order is accepted.

The customer will be provided with the applicable pricing and service charges associated with the order before or during order confirmation, where reasonably practicable.

6. NON-PROFIT SERVICE OPERATION

Shaman Dreams Wellness does not operate its delivery service for the purpose of generating profit from the sale of cannabis products.

Funds received through the Services are used to offset the costs associated with providing those Services and to compensate drivers, shoppers, associates, and other individuals performing work on behalf of Shaman Dreams Wellness.

Any remaining funds may be used for ordinary operating expenses, business development, equipment, technology, transportation, maintenance, administration, and other legitimate costs associated with operating and maintaining the service.

The purpose of the Services is to provide customers with convenient access to personal shopping, procurement, and delivery assistance while reasonably compensating the individuals and resources necessary to provide that service.

7. PRODUCT AVAILABILITY AND SUBSTITUTIONS

8. REFUNDS AND ORDER RESOLUTION — SUBSTITUTION-SPECIFIC PROVISION

A customer who receives a substitution that was selected in accordance with these Terms does not automatically become entitled to a refund solely because the substitute differs from the originally requested product.

Customers who require a particular product, brand, strain, potency, format, or other characteristic must identify that requirement in the order notes at checkout.

Where a customer has provided specific substitution instructions and Shaman Dreams Wellness fails to reasonably follow those instructions, the company may review the circumstances and determine an appropriate resolution.

Where no specific substitution restriction was provided, Shaman Dreams Wellness may rely upon the customer's general authorization for reasonable substitutions as described in these Terms.

Shaman Dreams Wellness may, at its discretion, provide a replacement, additional service, service credit, complimentary item, discount, or other accommodation when circumstances warrant.

Any such accommodation is a discretionary goodwill gesture and does not create an obligation to provide the same accommodation in future transactions.

9. ORDER ACCEPTANCE

Submitting an order request does not necessarily constitute acceptance of the order by Shaman Dreams Wellness.

An order becomes accepted when Shaman Dreams Wellness confirms that it is willing and able to provide the requested Services under the applicable terms.

We reserve the right to decline an order before acceptance for any lawful reason, including but not limited to:

• Product availability;
• Delivery distance;
• Driver availability;
• Financial feasibility;
• Safety concerns;
• Customer eligibility;
• Verification requirements;
• Operational limitations; or
• Other circumstances affecting our ability to provide the Services.

10. CUSTOMER INFORMATION

Customers are responsible for providing accurate and complete information, including:

• Name;
• Telephone number;
• Delivery address;
• Apartment, suite, or unit information;
• Special delivery instructions;
• Identification information when required; and
• Any other information reasonably necessary to complete the delivery.

Shaman Dreams Wellness is not responsible for delays or failed deliveries caused by inaccurate, incomplete, or outdated information supplied by the customer.

11. AGE AND IDENTITY VERIFICATION

Customers must satisfy all applicable legal age, identification, and eligibility requirements before receiving products.

Customers may be required to provide valid government-issued identification or other legally required documentation.

Shaman Dreams Wellness reserves the right to refuse or terminate a delivery when required verification cannot be completed.

12. DELIVERY

Delivery times are estimates and are not guaranteed unless expressly agreed otherwise.

Delivery may be affected by:

• Traffic;
• Weather;
• Vehicle problems;
• Retailer delays;
• Inventory issues;
• Customer delays;
• Road conditions;
• High order volume;
• Driver availability;
• Regulatory requirements; or
• Other circumstances beyond our reasonable control.

Shaman Dreams Wellness will make reasonable efforts to complete accepted deliveries in a timely manner.

13. CANCELLATIONS

Customers may request cancellation of an order before fulfillment.

Once an order has been accepted, products have been procured, or a driver has begun traveling to fulfill the request, cancellation may no longer be available.

Cancellation and refund eligibility is governed by the applicable refund policy and these Terms.

14. REFUNDS AND ORDER RESOLUTION

Because Shaman Dreams Wellness provides a personal shopping and delivery service, customers acknowledge that costs may be incurred before a delivery is completed.

Except where otherwise required by applicable law or expressly agreed by Shaman Dreams Wellness, completed service requests are not automatically refundable solely because a customer later changes their mind or becomes dissatisfied with an otherwise properly fulfilled request.

When an issue occurs, Shaman Dreams Wellness may, at its discretion, attempt to resolve the matter through:

• Replacement;
• Correction of an order;
• Additional service;
• Service credit;
• Discount;
• Complimentary service;
• Other accommodation; or
• Another mutually acceptable resolution.

Any goodwill accommodation is discretionary and does not establish an obligation to provide the same accommodation in future transactions.

15. CUSTOMER RESPONSIBILITY

Customers are responsible for the products they request and receive after completion of the delivery.

Customers are responsible for complying with all applicable laws governing possession, storage, transportation, and use of cannabis products.

Customers should carefully review product packaging, labeling, dosage information, and other applicable information before use.

16. NO MEDICAL ADVICE

Shaman Dreams Wellness does not provide medical advice.

Nothing contained on our website, application, platform, product descriptions, advertisements, communications, or through our associates should be interpreted as a diagnosis, medical recommendation, treatment plan, or substitute for professional medical advice.

Customers should consult a qualified healthcare professional regarding medical conditions, medications, interactions, or other health concerns.

17. THIRD-PARTY PRODUCTS AND SOURCES

Shaman Dreams Wellness may obtain products from third-party retailers, manufacturers, processors, cultivators, or other authorized sources. Shaman Dreams Wellness does not manufacture, cultivate, process, or independently guarantee the characteristics or effects of third-party products unless expressly stated otherwise. Product descriptions, photographs, potency information, strain information, effects, and other product information may originate from third-party sources and may not always be completely current.

Customers should rely upon the product's actual packaging and applicable source information for final product information.

18. PRODUCT QUALITY CONCERNS

Customers who believe that a product is defective, damaged, contaminated, mislabeled, or otherwise unsafe should discontinue use and contact Shaman Dreams Wellness promptly.

We will make reasonable efforts to assist customers in addressing legitimate product concerns.

Shaman Dreams Wellness does not guarantee that any particular product will produce a particular effect or result.

19. RESPONSIBLE USE

Cannabis may cause impairment and may affect individuals differently.

Customers are responsible for using cannabis responsibly and in accordance with applicable law.

Customers should not drive, operate machinery, or perform activities requiring full attention while impaired.

20. CUSTOMER COMMUNICATIONS AND CONDUCT

Customers authorize Shaman Dreams Wellness to communicate with them regarding orders, product availability, substitutions, delivery, scheduling, verification, payment, cancellations, and other matters necessary to provide the Services. Customers agree to communicate respectfully with Shaman Dreams Wellness owners, founders, associates, affiliates, drivers, contractors, and representatives. Shaman Dreams Wellness reserves the right to refuse future service to customers who engage in threats, harassment, intimidation, abusive conduct, fraud, or other inappropriate conduct, to the extent permitted by law.

21. ASSUMPTION OF RISK

The customer acknowledges that the use of cannabis products involves inherent risks and that individual reactions may vary.

The customer voluntarily assumes responsibility for the customer's decision to request, possess, and use any product obtained through the Services.

22. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, Shaman Dreams Wellness makes no express or implied warranties regarding:

• The availability of any particular product;
• The suitability of any product for a particular customer;
• The effects of any product;
• The therapeutic value of any product;
• The uninterrupted availability of the Services;
• Delivery times;
• Third-party products;
• Third-party retailers; or
• Any particular outcome resulting from use of the Services.

The Services are provided on an "as available" basis.

23. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHAMAN DREAMS WELLNESS, ITS OWNERS, FOUNDERS, MEMBERS, MANAGERS, OFFICERS, ASSOCIATES, AFFILIATES, EMPLOYEES, CONTRACTORS, DRIVERS, AGENTS, REPRESENTATIVES, PARTNERS, SERVICE PROVIDERS, AND OTHER PERSONS OR ENTITIES ACTING ON ITS BEHALF SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, LOSSES, CLAIMS, COSTS, EXPENSES, OR LIABILITIES ARISING OUT OF OR RELATING TO:

• (A) THE CUSTOMER'S USE OF OR INABILITY TO USE THE SERVICES;
• (B) ANY PRODUCT REQUESTED, PROCURED, TRANSPORTED, OR DELIVERED THROUGH THE SERVICES;
• (C) THE CUSTOMER'S POSSESSION, CONSUMPTION, MISUSE, OR USE OF ANY PRODUCT;
• (D) PRODUCT EFFECTS, SIDE EFFECTS, ADVERSE REACTIONS, OR INDIVIDUAL RESPONSES;
• (E) PRODUCT AVAILABILITY OR SUBSTITUTIONS;
• (F) DELIVERY DELAYS, INTERRUPTIONS, OR FAILURES;
• (G) ACTIONS OR OMISSIONS OF THIRD-PARTY RETAILERS, MANUFACTURERS, PROCESSORS, CULTIVATORS, OR OTHER THIRD PARTIES;
• (H) CUSTOMER-PROVIDED INFORMATION;
• (I) CUSTOMER CONDUCT;
• (J) LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, DATA, OR GOODWILL; OR
• (K) ANY CLAIM, DEMAND, DISPUTE, LITIGATION, LEGAL PROCEEDING, OR OTHER ACTION ARISING FROM OR RELATING TO THE CUSTOMER'S USE OF THE SERVICES.

To the fullest extent permitted by law, the customer agrees that Shaman Dreams Wellness and the persons and entities identified above shall not be held legally liable for damages, losses, claims, or litigation arising from the customer's use of the Services.

Nothing in these Terms is intended to create liability where none otherwise exists.

24. INDEMNIFICATION

To the fullest extent permitted by applicable law, the customer agrees to defend, indemnify, and hold harmless Shaman Dreams Wellness and its owners, founders, associates, affiliates, employees, contractors, drivers, agents, representatives, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:

• The customer's violation of these Terms;
• The customer's violation of applicable law;
• The customer's misuse of the Services;
• The customer's use or possession of products;
• Information supplied by the customer; or
• Conduct occurring after delivery or completion of the Services.

25. RIGHT TO REFUSE SERVICE

Shaman Dreams Wellness reserves the right to refuse, cancel, suspend, or terminate any order or customer relationship when reasonably necessary to protect the business, its personnel, its customers, or its ability to provide Services.

This includes circumstances involving:

• Financially infeasible deliveries;
• Unsafe conditions;
• Fraud;
• Abuse;
• Threats;
• Repeated violations of these Terms;
• Inability to verify eligibility;
• Product availability;
• Operational limitations; or
• Other legitimate business considerations.

26. ELECTRONIC ACCEPTANCE

The customer agrees that clicking an "I Agree," "Place Order," "Submit Order," or similar button constitutes an electronic signature and affirmative acceptance of these Terms.

Electronic acceptance shall have the same effect as a written signature to the extent permitted by applicable law.

27. MODIFICATIONS TO THESE TERMS

Shaman Dreams Wellness may modify these Terms from time to time.

The version of these Terms accepted by the customer at the time an order is placed will govern that transaction, except where modification is required by law or otherwise expressly permitted.

28. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall remain in full force and effect.

29. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the applicable laws governing the Services and the jurisdiction in which the applicable transaction occurs.

30. ENTIRE AGREEMENT

These Terms, together with any applicable order confirmation, refund policy, privacy policy, and other policies incorporated into the Shaman Dreams Wellness platform, constitute the entire agreement between the customer and Shaman Dreams Wellness concerning the Services.

31. CUSTOMER ACKNOWLEDGMENT

By using the Services, the customer acknowledges and agrees that:

• I understand that Shaman Dreams Wellness provides personal shopping, procurement, coordination, transportation, and delivery services at my request.
• I authorize Shaman Dreams Wellness to shop and procure products on my behalf within the scope of the Services.
• I understand that product availability is not guaranteed and that substitutions may be necessary.
• I understand that $2.00 per mile is the standard service and delivery rate, unless another amount is agreed upon for my particular order.
• I understand that Shaman Dreams Wellness is not required to accept a delivery request that is financially impractical or would result in a loss to the business.
• I understand that product pricing may include variable markups associated with the cost of providing the Services.
• I have read, understood, and agreed to these Terms & Conditions of Service.
• By submitting my order, I electronically acknowledge my acceptance of these Terms.
